These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Geroque Inc., a Canadian corporation ("Company," "we," "us," or "our"), governing your access to and use of the SolveKar AI mobile applications (iOS and Android) and website (the "Service").
1. Acceptance of Terms
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Service.
2. Eligibility & Age Requirement
- Minimum Age: You must be at least 13 years old to use this Service.
- Minors: If you are under 18, you represent that you have the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
3. Description of Service & AI Disclaimer
SolveKar AI provides educational assistance using artificial intelligence models (including Gemini 3.1 Flash-Lite and Pro).
3.1 AI Accuracy Warning
AI CAN MAKE MISTAKES. You acknowledge that the AI-generated solutions provided by SolveKar may contain errors, hallucinations, or mathematical inaccuracies. SolveKar is an educational aid, NOT a substitute for professional tutoring or official textbook solutions. Users are solely responsible for verifying the accuracy of any output before relying on it for exams or assignments.
3.2 Academic Integrity
SolveKar AI is an educational tool designed to help students understand complex problems. You agree not to use the Service during live examinations or in any manner that violates the academic integrity policies of your educational institution. Geroque Inc. is not responsible for any disciplinary actions taken against you by your school or board.
4. Subscription Tiers & "Energy" Model
- Free Tier (India/Global): Access to "Lite" scans is provided at no monetary cost but requires the consumption of "Energy" earned by viewing Rewarded Video Advertisements. To unlock one (1) Elite Solve, the user may be required to watch up to four (4) advertisements.
- Premium Tiers: Paid subscriptions remove advertisements and provide a set monthly quota of Elite and Non-Elite scans as detailed in the app's "Plans" section.
- Usage Limits: We reserve the right to implement rate limits on all tiers to ensure system stability.
5. Payments, Refunds & "Sachet" Transactions
- Payments: All payments are processed via Apple App Store, Google Play Store, or authorized Indian payment gateways (e.g., UPI).
- Refunds: Due to the immediate digital nature of AI processing costs, all "Sachet" (one-time) purchases and monthly subscriptions are non-refundable, except where required by local consumer law (e.g., Canada's Consumer Protection Act).
- Cancellations: You may cancel your subscription at any time through your device's App Store settings.
- Payment Grievances: For payment-related grievances in India, we will acknowledge your complaint within 48 hours and aim to resolve the issue within 72 hours for failed transactions, or within 15 days for complex disputes, as per Indian e-commerce regulations.
6. Intellectual Property Rights
- Ownership: Geroque Inc. (Canada) owns all rights, title, and interest in and to the SolveKar AI platform, including its proprietary code, UI/UX design, branding, and original AI-logic "Work."
- User Content: You retain ownership of the images/problems you upload. By uploading, you grant Geroque Inc. a non-exclusive, royalty-free license to process, anonymize, and cache the content solely to provide and improve the Service.
- Prohibitions: You may not reverse-engineer, scrape, or attempt to extract the source code of the SolveKar AI models or application.
7. Limitation of Liability
To the maximum extent permitted by the laws of Ontario, Canada, and the Republic of India:
Geroque Inc. shall not be liable for any indirect, incidental, or consequential damages, including but not limited to academic failure, exam disqualification, or data loss resulting from the use or inability to use the Service.
8. Governing Law & Dispute Resolution
- Governing Law: These Terms are governed by the laws of the Province of Ontario, Canada.
- Arbitration: Any disputes shall first be attempted to be resolved through informal mediation. If unsuccessful, disputes will be settled via binding arbitration in Toronto, Ontario, or as otherwise required by mandatory local consumer protection laws in the user's jurisdiction.
9. Modifications to Service
We reserve the right to modify pricing, ad requirements (e.g., changing the number of ads required for a solve), or AI model versions at any time to maintain service sustainability.
